Aquatic Artists LLC offers optional SMS communications to customers and prospects who choose to receive them. These terms describe our two separate text-message categories.
1. Program description
- Project & Service Text Updates: Non-marketing messages about your inquiry, estimate, appointment, project, installation, or customer service.
- Marketing & Promotions Texts: Recurring automated marketing and promotional messages, including news, offers, and our waterfall construction services.
Aquatic Artists designs and builds custom waterfalls and water features in New Jersey, Pennsylvania, Delaware, and Maryland. Messages are limited to the categories for which you have consented.
2. Separate, optional consent
At our contact form, you may select either, both, or neither of the two optional, unchecked SMS consent boxes. Providing a phone number or submitting a form does not by itself authorize SMS. Consent to service texts is not consent to marketing texts, and neither choice is a condition of purchase. We use your mobile number and the consent choices you submit to honor the categories you select.
Both choices are optional. You can submit an inquiry or request an appointment without agreeing to any texts. Accepting these terms does not constitute consent to marketing texts. By choosing Marketing & Promotions Texts, you agree to receive recurring automated promotional messages from Aquatic Artists LLC at the number you provide. You confirm that you are the subscriber or authorized user of that mobile number. Consent applies only to Aquatic Artists LLC; it does not authorize texts from another company.
Where START/resubscription is supported on a texting number, it may restore text delivery after an opt-out; it does not itself create separate written marketing consent. To opt into marketing texts, select the Marketing & Promotions Texts checkbox on our website.

5. Opt-out instructions
Reply STOP to opt out of texts from the sending number. You will receive a confirmation and no further messages from that number unless you opt in again. Contact us if you need help updating your preferences.

7. Privacy
We do not sell or share your mobile number, text messaging originator opt-in data, or consent with third parties or affiliates for their marketing or promotional purposes. Consent applies only to Aquatic Artists LLC and to the message categories you select; it is not transferred to another company.
We may use trusted service providers to deliver messages and manage customer communications on our behalf. They may process information only to perform those services for us, not for their own marketing or promotional purposes.

8. Carrier disclaimer
Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and network availability and is not guaranteed.
9. Eligibility
By opting into our SMS program, you confirm that you are at least 18 years of age or have the permission of a parent or legal guardian and are authorized to use the mobile number provided.
10. Changes to these terms
We may update these terms by posting a revised version with a new effective date. Changes to these terms do not automatically enroll you in a different message category or expand your existing consent.
